BBC 15/4/2021 News Misunderstandings, Mischaracterizations, and Malicious Accusations: A Reply to Walby’s (2021) Swat Everywhere? To develop a more informed understanding of why tactical officers are used in Canada, we interviewed patrol and tactical officers from three Canadian police services (Jenkins et al., 2020). Interviewees indicated that tactical officers tend to be used on calls that go beyond the capabilities of patrol officers, including high-risk calls and calls unfolding in special environments, and that their use results in reduced threat to police and public safety. In response, Walby (2021) has argued that evidence-based policing (EBP) research of the sort we conducted is inherently biased. He also criticized our understanding of existing literature, took aim at our research methodology and conclusions, and questioned our academic integrity by claiming that we were paid by the participating police services to conduct the research. While Walby makes some valid criticisms of our research, his response is riddled with misunderstandings, mischaracterizations, and malicious (unfounded) accusations. After setting the record straight with respect to allegations regarding our nefarious motives to conduct the research, we argue that Walby completely misrepresents EBP research when he argues that it aims to support harmful police practices in exchange for financial support. We then correct numerous instances where Walby either mischaracterizes existing research or misrepresents our views (and those of our interviewees) when it comes to the use of tactical officers. We conclude by calling for more inclusive conversations to take place to address the issue of police militarization. These conversations must include community members, but they must also include the police Police Journal - Registration at source 15/4/2021 Research article Re-Thinking Governance and Accountability of Police and Policing: David Bayley’s Contributions to the Debates As a political scientist, David Bayley brought a very particular perspective to debates about police governance and accountability that have recently flared up again in the United States of America following the killing of George Floyd and the Black Lives Matter and “Defund the Police” campaigns that it energised. Throughout his 65-year career as the world’s leading international comparative policing scholar, Bayley wrote and spoke publicly about police governance and accountability in his native U.S.A. and many other countries around the world, as well as how it pertained to international post-conflict peace-keeping operations. In this article, I consider the proposals for reform of police governance and accountability that have been advanced following George Floyd’s death, in light of Bayley’s lifelong thoughts and proposals on this topic, culminating with his last book (which I was privileged to have co-authored with him), Governing the Police: Experience in Six Democracies International Journal of Comparative and Applied Criminal Justice 15/4/2021 Research article Do New Chiefs Mean Fresh Perspectives? the Institutionalization of the Police Executive Environment Research suggests policing is a highly institutionalized field. Limited attention has been paid, however, to the institutionalization of leaders’ views. Assessing turnover in 71 Texas police organizations between October, 2011, and July, 2015, this research evaluates whether there is consistency (i.e., institutional homogenization) after turnover in chiefs’ perceptions of their environments and agency priorities. The research is unique in that it assesses two chiefs’ perceptions that have both led the same law enforcement agency in successive time periods. Assessments of environment and priorities from former chiefs and those replacing them are evaluated utilizing descriptive, bivariate, and multivariate methods. These assessments are also compared with a control group of chiefs from agencies not experiencing turnover. Bivariate results suggest little variation across current and former chiefs, whereas ordinary least squares (OLS) regression models suggest differing relationships across chiefs groups between environmental perceptions and agency priorities. Discussion of the findings is framed by institutional theory. Criminal Justice and Behaviour - Registration at source 15/4/2021 Research article Police Officers’ Qualified Immunity in Excessive Force Claims, Warrant Execution, and Warrantless Searches and Arrests: Tracing the Evolution Of, and Stagnation In, U.S. Supreme Court Precedents We analyzed all U.S. Supreme Court cases as of June 6, 2020 where private complainants filed either a §1983 action or Bivens action against police officers who claimed the defense of qualified immunity (N = 29). Empirical analysis of qualified immunity claims involving excessive force, unlawful warrant executions, and unlawful warrantless searches and arrests reveal the Court’s growing trend of ruling in favor of police officers. In 10 out of 13 cases involving excessive force claims, three out of five unlawful warrant execution claims, and nine out of 10 unlawful warrantless searches and arrests claims, the Court granted police officers’ qualified immunity. The requirement for private complainants to identify a case where the Court ruled against the officer in similar circumstances makes it extremely difficult to defeat the defense of qualified immunity. The Court should reconsider its standard of proving “clearly established rights,” an element of qualified immunity.
